I highly doubt a 335xi falls under $40,000 because it starts at $42,000.

They don't make a Mazda6 wagon anymore for North America, and the only 3.0 turbo BMW under $40K is the 135i.

More expensive and less practical than either, and not even the gas mileage is significantly better. Plus, it has like a 70 inch wheelspan.

Had some trouble making this list with new cars without having them all be Volkswagens. Stupid Audi not offering the 2.0T TT with a manual anymore! Forced me over to BMW. And damn Volvo for cutting down the V50 range and only offering an automatic with the T5.

Those are built prices. I took the $40K limit as a limit including options.
