New Mexico man given forced anal search and colonoscopy after traffic stop

So much for constitutional rights against unreasonable search in the good ol' US of A!

When David Eckert left the Wal-Mart parking lot in Deming, NM, he apparently failed to come to a complete stop at a stop sign. What happened next is the stuff of prison-planet nightmares.

In a nutshell, the innocent motorist's 14-hour ordeal went as follows....

1. Eckert's abdominal area was X-rayed; no narcotics were found.

2. Doctors then performed an exam of Eckert's anus with their fingers; no narcotics were found.

3. Doctors performed a second exam of Eckert's anus with their fingers; no narcotics were found.

4. Doctors penetrated Eckert's anus to insert an enema. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

5. Doctors penetrated Eckert's anus to insert an enema a second time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

6. Doctors penetrated Eckert's anus to insert an enema a third time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

7. Doctors then X-rayed Eckert again; no narcotics were found.

8. Doctors prepared Eckert for surgery, sedated him, and then performed a colonoscopy where a scope with a camera was inserted into Eckert's anus, rectum, colon and large intestines. No narcotics were found.


To add insult to injury, the hospital that performed the illegal search at the behest of the cops then billed Eckert for their "services"!

Turns out this isn't the first time a motorist has been physically violated by doctors at the request of Deming, NM police officers.


"Another man, another minor traffic violation, another incident with Leo the K-9 and another example of the violation of a man's body.
Police reports state deputies stopped Timothy Young because he turned without putting his blinker on.
Again, Leo the K-9 alerts on Young's seat.
Young is taken to the Gila Regional Medical Center in Silver City, and just like Eckert, he's subjected to medical procedures including x-rays of his stomach and an anal exam.
Again, police found nothing, and again the procedures were done without consent, and in a county not covered by the search warrant."

This kind of thing can happen anywhere in the country. Abuse of power is becoming much to frequent.

Details aside, the lesson to be taken away from this incident is that you are powerless. You either submit or you "resist" and are shot.

Makes you wonder if all of those reports of people being abducted by aliens and probed were just drunk recollections of people being picked up by the Deming police department.

I think we have to get the whole story. They can't just force you to do this, period - even with a warrant. I'm assuming he did not ask to speak with an attorney before any of this stuff happened to him.

Not excusing, AT ALL, the actions of the police department here, but (whether he knew it or not) the suspect was likely legally entitled to stop this process if he really wanted to. Although he likely would have had to do it early on.

ALSO: Keep in mind that this guy wasn't just an average citizen stopped on a motor vehicle violation. He was a known drug dealer who had been convicted of hiding drugs in his rectum previously. If I had to drive through this town, I would not be particularly worried about this happening to me.

At the end of the day, this guy is likely going to be a millionaire. Or at the very least, he'll have gotten a free colonoscopy – and a stroke of luck that he wasn't boofing at the time.

TheBlaze is owned (in part) by Glenn Beck, thought it's a more mainstream version of his whacky talk shows over the years. It's regarded as mostly legitimate, employing legitimate journalists (I actually know a liberal guy who works there who used to work for Huffington Post), and essentially a right-leaning answer to Daily Beast and HuffPo.

Gotta say, it's a pretty convincing argument if it's more than just a civil infraction. Like, I'm pretty good at not getting tickets, but I don't think I could talk my way out of a murder charge the police thought they had evidence for. :huh:

There's alot of ground between a civil infraction and a murder charge. I wouldn't talk without a lawyer present if I was looking at a murder charge, either, but there's lots of stuff I would consider giving a statement about if I was clearly innocent. The article is borderline "no snitching cuz the corrupt cops will burn your ass" in its mentality.

The article I was talking about was really a 50 min video of a law lecture, and I didn't even read the few lines below it. It's not corrupt cops, it's innocent mistakes.
