What do you guys think aboot my speeding ticket?

I got this ticket last July. Got caught 58 km/h on a 40 km/h zone (36/25mph). The cop was pretty nice, he showed me the radar, asked me how my driving record is (I didn't lie to him. It was not good at the time, got caught speeding 3 days earlier and that ticket alone can get my license suspended, which later the judge dismissed.[:halo:].)

Buddy there lowered it to 14 km/h over, no points and the ticket cost $52.50 CDN. I had to plead not guilty because of the ticket 3 days before.

I have court June 03,2005. I took some pictures and am going to show the judge that it's pretty unreasonable for the road to be a 40km/h (25mph)zone. It's a 4 lane road and not a residential area or school zone. Pics are at the bottom.

What do you guys think?

The cop was sitting at the very far end, way behind the bridge which you can't even see.
   
I took this pic yesterday and there is a cop with a radar gun giving out tickets, right where I got stopped.<_<

The judge is going to say "I see a black and white sign there that indicates 40km/h. That's the speed limit." That's like saying "I think the highways should be 150km/h so that's what I was doing." What YOU think it should be has no bearing on whether you should get a speeding ticket or not. There must be a reason (not necessarily a good one in everyone's eyes) it's only 40 although I don't know what it is since I don't know the area.

I don't understand what you mean when you say you HAD to plead not guilty because of the other ticket. Do you mean for insurance reasons?

EDIT: How freaking big was your other ticket that could have got your licence suspended??? It was at least 50 over....

I just noticed yesterday it had the 40km/h signs all over when I went and took the pictures.  :o

I had to plead not guilty to delay this one (the other one was a summons, I believe court date was a month later August,2004) so it won't look like I'm a speeding freak for having 2 speeding tickets in 3 days.   :P

Yes, it was over 50km/h on the highway which I believe the speed limit should be. :lol:  :lol:

I would have to agree that by the looks of the street it should probably have a 35 or 40 mph speed limit, but unfortunately that's probably not a good enough argument.

If it were me, the speed limit would be 50kph, but I don't make the rules.

The officer will probably have noted your actual speed. When he mentions that in court, that will probably be the end of that.

You could try the "Plead guilty with an explanation" option, but I wouldn't mention your 50kph over ticket as a reason... lol...

I would just try to keep to the limits in the city period, 10kph over tops. The pictures you provided give enough of a reason. Pedestrians, side roads, buses, hospital, etc... There are just too many things to keep track of to risk it. A ticket is the best of the worst things that could happen.

Pleading guilty with an explanation will still show up as a conviction on his record since he 'pled guilty'. The only thing he may get is a reduced fine or more time to pay.

Do you guys have court supervision in Canada?


I had 2 tickets [see other thread]. Plead guilty for them both. I was under supervision for the first until I got the other more severe ticket [speeding, 15 over]. Now I'm under supervision for the speeding ticket but I was convicted for the first.

I think it's best to play it safe in urban areas and not mess around too much.  There are too many chances to f''k up and cause worse things than a traffic citation.

The conviction shows up as a conviction for speeding no matter when the payment date is. Is that what you're asking? Or are you thinking of getting a year to pay and then your insurance company won't see both convictions for a while....?

Anyhow, what I was trying to figure out is whether or not an incident shows up on your MVR at all prior to when you pay the fine.

Caspar, I have to tell you that I think the ticket you got was perfectly fair.

I'd also say that you're not going to get anywhere in court by arguing that the posted speed limit is too low.  Very few judges are going to accept your wisdom about what the speed limit should be over the highway department, legislature, or who set the speed limits.  You may be right in your judgment, but a judge isn't going to buy it.

Practically speaking, your only hope is to convince a judge that you were not going the speed you were accused of going.  Either that, or plead down to a lesser charge, which brings reduced penalties and points, ideally no points.

A good friend will come bail you out of jail...BUT, a true friend will be sitting next to you saying, DAMN...that was fun!

You are correct on the ticket date and conviction date.  Being an Allstate agent I look at MVRs all day long and you have both of them.  We use the conviction date for our discount system which I don't like because some drivers would have tickets from January and not be convicted till April.  This kicks alot of people out of favorable discounts until renewal time.

That is why I paid for the ticket on monday.  :D

I still believe the speed limit is kinda low, but almost a year later, the cops are still holding their radar guns and ticketing people, there must be a reason.  <_<

I would have paid the ticket right away if it weren't for the other ticket. It's only $52.50 and no points.

Dude, you made out very well, getting no points.  I wouldn't worry further about it, and just be a little careful at spots where you know the cops are out to nail people.
